This is to inform you, in accordance with the requirements of the Nuclear Non-Proliferation Act, that NRC has not completed licensing action on your application XCOM0088 for the export of components to West Germany which was received by NRC over 60 days ago.

We are unable to issue a license on this export request because it does not meet criterion 3 of Section 110.42(b) of our licensing regula tions.

Specifically, criterion 3 states that "no such equipment or material will be retransferred without the prior approval of the United States."

To meet this requirement, the Department of State has contacted the West German Government with respect to obtaining a generic assurance that no retransfers will be pennitted without US approval.

This assurance has not yet been received.

We have taken steps, however, to act expeditiously on your license application upon receipt of the assurance.,
