1. The Staff withdraws its motion for summary disposition of Contention 2(d)intheabohereferencedproceeding.

2.InterhenorwithdrawsContention2(d).

3.Withtheexceptionofthethreealternatihesexplicitly mentioned in Contention 2(d) Intervenor reserves the right to submit tes'timonyonallalternatihesmaderelevanttothisproceedingbythe other contentions admitted into controversy and by Board questions and orders. The Staff reserves the right to object to the submission of such testimony on appropriate grounds.

4. The parties hahe entered into this.tipulation in a spirit of compromise and cooperation with the goal of minimizing procedural disputes;
