In our Prehearing Conference Order of April 3, 1979 (LBP-79-10), we ruled that Citizens for Equitable Utilities, Inc. (CEU) should have 30 days from the service date of that Order within which to file additional information with respect to its contentions.
On April 22, 1979, CEU filed a motion for continuance, advising that it was never served with the Order and seeking additional time within which to file the requested information.
Our office was advised by telephone on April 18, 1979, of this service deficiency, and on that date we mailed an additional copy of the Order to CEU.
Under Commission rules, we presume that CEU received this copy by April 23, 1979.
The Applicants do not oppose the continuance to the extent that it does not result in an extension beyond May 29, 1979 idu 2251 065 7906200 2 3'/
6-(the date sought by the NRC Staff in the motion described below).
In our April 3, 1979 Order, we also ruled that CEU and Citizens Concerned About Nuclear Power, Inc. (CCANP) should attempt to reach agreement with the Applicants and Staff with regard to the wording of various contentions, and.that all parties should report to us on their progress within 30 days of service ('i.e., by May 8, 1979).
We also asked CEU, absent any agreement, to supply us with additional information.
By motion dated April 20, 1979, the Staff requested an extension of time to May 29, 1979 for the filing of the requested reports.
CEU, CCANP and the Applicants do not oppose this request.
Good cause having been shown, the Staff's motion for an extension of time until May 29, 1979 for various parties to file their repo-c(s) on contentions is hereby granted.
