ASc 9 ACCIDRNTS AND RENFWING MOTION TO CONSIDER CLASS 9 ACCIDENTS Althouch intervenor SCANP has, since the outset, contended that Class 9 accidents are an appropriate and necessary issue in this proceedino (Intervenor's Contention J9), the staff has heretofore taken the position that such incidents should be disrecarded in connection with site s af e ty and envi ronmental imcact analysis.

In view of the recent incident at the Three > file Island clant in Pennsylvania, the ba sis for staf f 's ref us'al to consider the Class 9 accident in connection with safety analysis, and envi ronmental impact s ta teme nt orecaration, has disacpeared. The Three Mile Island incident was an actual or cotential Class 9 accident.

g, The staff has preoared an environmental imoact state-ment, and a supolement, to support the action of the Commis-sion in connection with this licensino oroceedina. In the EIS, the ehenomena of Class 9 accidents was explicitly disrecarded. (See EIS, po. 7-1 to 7-2.). The supolemental EIS totally icnores the Class 9 accident.

It is intervenor's understanding that not only the NRC, but a special commission appointed by the President, is studyino the Three Mile Island incident. Intervenors believe that it would be appropriate, therefore, for the Licensina Board to direct the staf f to review all matters at issue in this croceedino, and to report back to the Licen-sina Board and the other parties in a reasonable time, (such as 90 d ays), with resoect to whether or not:

1. The staff position on any issue in this procedino should be modi fied to reflect a consideration of the Three Mile Island accident, and if so, when such modi fication can be expected.
2. Whether it would be aporopriate to supolement the oricinal EIS and supplemental EIS, to account for, discuss, disclose, and analyze, the consequences of Class 9 acci-dents, or at least, the actual consecuences of the Three Mile Island accident, with respect to licensinc this site.

Secondly, intervenors request that the Board rule that the actual and potential consecuences of the Three Mile 2260 M

Island accident, and of the ootential for such an accident at the Skagit site, be considered in this oroceedino, and evidence be received accordingly, and that intervenors be entitled to maintain their contention JC.
