REPORT OF Tile DEPARTMENT OF JUSTICE - DECEMBER, 1978 Purcuant to the order of the Atomic Safety and Licensing Board (Board) of June 21, 1978, the Department of Justice (Department)' submits this report on the progress made in completing discovery during the month of December.
On December 4, 1978, the Department served sets of inter-rogatories and requests for the production of documents upon counsel for the Cities of Austin and San Antonio.
The res-ponses to these interrogatories and document requests are due in early January.
Also during December, counsel for Houston Lighting and Power (!!LFP ) and Texas Utilities Generating Co. (TUGCO) requested extensions of time from the Board for responding to the Department's FIRST SET OF INTERROGATORIES AND REQUESTS FOR PRODUCTION OF DOCUMENTS.

TUGCO requested an extension to January 12, and IIL&P has been granted an extension to January 15.
The Department opposed neither of these motions.
The Department is studying the responses of the NRC Staff to HL&P's PIRST SET OF INTERROGATORIES AND REQUESTS FOR PRODUCTION OF DOCUMENTS.
The Department has also made arrangements to review the documentary production made by the Staff to HL&P.
As indicated in the Department's progress report for the month of November, the Department requested in October that counsel for TUGCO furnish a list of documents claimed to be privileged.
In its November progress report and in conversations with attorneys from the Department, counsel for TUGCO stated that it expected shortly to provide the g
requested information.
This position was reiterated before the Board during the December 5, 1978 pretrial conference.
On December 11, the Department communicated by telephone with Washington counsel for TUGCO and was once again assured that the list would soon be supplied.
As of this date, the list has not been produced.
If the list is not furnished in the very near future, it will be necessary for the Department to request formally that this Board direct prompt production of the list.
Y Throughout the entire month of December, the Department continued its process of reviewing discovery materials already received.
