The NRC Staff, as authorized in toe Licensing Board's Initial Decision (ID) dated December 26, 1978, has an January 4, 1979, issued ConstructionPermits(permits)in'hisproceeding. Copies of the pennits have, under separate cover, been forwarded to the Licensing Board and parties.

The purpose of this letter is to. advise the Board and parties of the following modifications to the fom of the pemits attached to the Board's ID:

1.

Condition 16 (on page 8 of the Board's pemit under conditions for the protection of the environment) ha'., been renumbered as Condition 3 and placed urier health and safety conditions. This condition, which was proposed in the Staff's Unopposed Motion for Imposition of a Licensee Conditio1 dated May 22, 1978, requires Applicant to Redesign the Non-Seismic Category I portion of the Fuel Building to Seismic I requi rements. The woMing of the condition remains as proposed by the Staff and approved by the Board. Renumbering was made for the Staff's

- administrative convenience.

The following paragraph has been included in the permits to reflect the " antitrust" status of this proceeding:

s no finding has been made that an antitrust hearing is otherwise required (10 CFR, Part 2, 2.104(d)),

antitrust review of the application for this construction pemit under Section 105c of the Atonic Energy Act of 1954, as acended, has been completed and a hearing thereon detemined to be unnecessary.
