D I am in receipt of your letter of December 8,1978 transmitting to me your letter of May 13, 1978 to the former Chairman of NRC, Mr. Marcus Rowden, relating to the application of Public Service Electric and Gas Company Inc. to amend the Salem Unit i license to expand its spent fuel storage capacity, s

The license amendment application is now pending before an Atomic Safety and Licensing Board (Board).

Since this Board will make the initial decision as to whether the license amendment should be granted, I have forwarded your letter to the Board and requested it, pursuant to section 2.715 of the Commission's Rules of Prac-tice, to treat your letter as a limited appearance statement.

As such, your recommendation to limit the time frame for allowing the storage of spent fuel at the Salem Unit 1 will be considered by the Board. A copy of the letter of transmittal to the Board is enclosed.

In your letter to Mr. Rowden you also suggest that the Commission

" consider halting all further nuclear activities" until the spent fuel storage problem is solved.

The Commission in its notice of

" Intent to Prepare Generic Environmental Impact Statement on Hand-ling and Storage of Spent Light Water Power Reactor Fuel" (40 Fed, Reg. 42801) (enclosed) considered whether to defer issuance of all operating license amendments to permit increases in the storage capacity of reactor spent fuel pools until the completion of the generic impact statement relating spent fuel storage.

Although the Commission decided that deferral was not requirc d, it direct-ed the Staff to consider deferral in each licensing p*oceeding, such as Salem Unit 1, in the Staff's

'ironmental imp act assess-ment or environmental impact statement.
