REQUEST FOR REVIEW AND CONCURRENCE OF DRAFT GUIDE-3054 GUIDANCE FOR IMPLEMENTATION OF 10 CFR 72.48, CHANGES, TESTS, AND EXPERIMENTS The purpose of this memorandum is to request concurrence (or concurrence with comments, or review for no legal objection) on Draft Regulatory Guide (DG)-3054, which is proposed Revision 1 of Regulatory Guide (RG) 3.72, Guidance for Implementation of 10 CFR 72.48, Changes, Tests, And Experiments. Key documents are attached, and the complete package is in the Agencywide Document Access Management System (ADAMS) under Accession No. ML19269B755. It would be appreciated if your response is provided within 2 weeks of receipt of this memorandum.

Revision 1 addresses updated guidance since the guide was originally issued. It describes an approach that is acceptable to Nuclear Regulatory Commission to meet regulatory requirements related to changes affecting independent spent fuel storage installations (ISFSIs), spent fuel storage cask designs, and monitored retrievable storage installations (MRSs) by endorsing a new guidance document NEI 12-04, Guidelines for 10 CFR 72.48 Implementation, Revision 2.

The program offices are requested to concur or concur with comment. The Office of the General Counsel (OGC) is requested to review the DG and provide a finding of no legal objection.Section IV, Backfit and Issue Finality of the Federal Register Notice is in draft form.

The OGC is requested to review and modify it as needed. The Advisory Committee on Reactor Safeguards (ACRS) is requested to review the DG and determine if additional information is needed or if there is a preference to review the documents after the guide has received public comments.

The ACRS has advised that, in general, the staff does not have to wait for an ACRS decision to review a DG before issuing it for public comment unless it is a new RG or a RG with implementing guidance for a current rulemaking. After public comments are addressed, the final RG will be submitted to the ACRS for review before issuance.

After internal review and concurrence, the agency will publish a notice in the Federal Register announcing the availability of this DG. The public comment period for this guide will be 60 days from the date of issuance. During this time Agreement States may also provide comments. If there are only editorial changes following internal concurrence and resolution of public comments, a second review and concurrence by the program offices will not be needed before publication of the final RG.
