REQUEST FOR REVIEW AND CONCURRENCE REVISION 1 OF REGULATORY GUIDE (RG) 1.166, PRE-EARTHQUAKE PLANNING, SHUTDOWN, AND RESTART OF A NUCLEAR POWER PLANT FOLLOWING AN EARTHQUAKE, AND THE WITHDRAWAL OF RG 1.167, RESTART OF A NUCLEAR POWER PLANT SHUT DOWN BY A SEISMIC EVENT The purpose of this memorandum is to request concurrence (or concurrence with comments, or review for no legal objection) on proposed Revision 1 of Regulatory Guide (RG) 1.166, Pre-Earthquake Planning, Shutdown, and Restart of a Nuclear Power Plant Following an Earthquake, and the withdrawal of related guide RG 1.167, Restart of a Nuclear Power Plant Shut Down by a Seismic Event. This revision of RG 1.166 represents a combination of the two guides. The combined guide was issued for public comment as Draft Regulatory Guide, DG-DG-1337 and the comment period closed on August 13, 2019. A second review by the program office(s) is being requested to review changes made as a result of the incorporation of public comments. Key documents are enclosed, and the complete package is in ADAMS under Accession No. ML19266A614. It would be appreciated if your response is provided within 2 weeks of receipt of this memorandum This revision of RG 1.166 merges two related RGs, that is, RG 1.166, Pre-Earthquake Planning and Immediate Nuclear Power Operator Post-Earthquake Actions, and RG 1.167 Restart of a Nuclear Power Plant Shut Down by a Seismic Event. The guides were merged because they are similar in nature and contain overlapping guidance. Both guides reference and endorse the same industry guidelines, which more recent industry guidance has superseded. The merged RG incorporates lessons learned following the shutdown and restart of nuclear power plants in response to earthquake ground motion and post-earthquake evaluations since issuance of the two RGs in 1997. As a result of the merger of the guides, RG 1.167 is no longer useful.
Therefore, it is being withdrawn and the bases for withdrawal are enclosed.
E. Benner, et al., RG 1.166 describes methods that the staff of the U.S. Nuclear Regulatory Commission (NRC) considers acceptable for use regarding pre-earthquake planning actions; actions necessary to determine the need to shutdown a nuclear power plant due to an earthquake; and the short-term and long-term processes, inspections, and tests to demonstrate that a nuclear power plant is safe for restarting after a shutdown in response to an earthquake.
Following concurrence by the program offices, the project manager (PM) for the Regulatory Guidance and Generic Issues Branch (RGGIB) will forward this memorandum to the Advisory Committee on Reactor Safeguards (ACRS) for consideration and concurrently to the Office of the General Counsel (OGC) for review for no legal objection.
