ENDORSEMENT OF NUCLEAR ENERGY INSTITUTE 18-11, MAINTAINING 10 CFR PART 95 FACILITY CLEARANCES FOR VOLUNTARY PROGRAM PARTICIPANTS, REVISION 1, DATED SEPTEMBER 2019

Dear Mr. Gross:

In your letter dated September 18, 2019, you requested the U.S. Nuclear Regulatory Commission (NRC) staffs review and endorsement of the Nuclear Energy Institutes (NEI)

NEI 18-11, Maintaining 10 CFR Part 95 Facility Clearance for Voluntary Program Participants, Revision 1, dated September 2019 (Agencywide Document Access and Management System Accession No. ML19261C470).

The NRC staff met with NEI and industry representatives on several occasions to discuss issues that affect participants in the voluntary program which allows designated power reactor personnel to receive access to classified information. The issues were related to reporting requirements and reducing the number of cleared Key Management Personnel. NEI submitted NEI 18-11, Revision 1, to capture the outcomes of these discussions and put forth recommendations that would reduce the burden on licensees in the voluntary program in complying with Title 10 of the Code of Federal Regulations (10 CFR) Part 95, Facility Security Clearance and Safeguarding of National Security Information and Restricted Data, while ensuring the protection of classified information.

The NRC staff concludes that implementation of NEI 18-11, Revision 1, dated September 2019, would be an acceptable method to comply with the requirements of 10 CFR Part 95 for participants in the Voluntary Security Clearance Program (i.e., for licensees and others for which access to classified information is not a condition of their license). Please note that as a Cognizant Security Agency under the National Industrial Security Program (NISP), the NRC is required to follow and implement NISP requirements for the protection of classified information.

If NISP requirements change, the NRC will transmit the new requirements to licensees under the voluntary program for their implementation.
