Withdrawal of NEI 03-01, Revision 4
Dear Ms. Helton:
The purpose of this letter is to withdraw the Nuclear Energy Institutes (NEI) request for review and endorsement of NEI 03-01, Revision 4, Nuclear Power Plant Access Authorization Program.1 On July 18, 2014, NEI submitted NEI 03-01, Revision 4, for the Nuclear Regulatory Commissions (NRC) review and endorsement. The letter states that NEI 03-01 has been revised to include an independent review process for access denials pertaining to individuals who currently hold unescorted access authorization (UAA) or unescorted access (UA) and they are determined to no longer be trustworthy and reliable and subsequently denied UAA/UA.
On April 4, 2019, the NRC staff submitted SECY 19-00332 requesting Commission approval to discontinue the rulemaking activity, "Access Authorization and Fitness-for-Duty Determinations." The submittal of the SECY prompted NEI to review the need for NEI 03-01, Revision 4. NEI has determined that Revision 4 is not necessary given that the rulemaking has been discontinued. Accordingly, NEI requests that the NRC suspend its efforts in reviewing and endorsing the proposed guidance document.
The current NRC-endorsed version of NEI 03-01 should remain Revision 3.
