On January 22 and February 27, 28, and 29, 1980, inspectors from the NRC's Region III office (Chicago) conducted an inspection of Nuclear Pharmacy's facilities in the Chicago area.

Identified items of noncompliance included an extremity overexposure, failure to make surveys or perform other monitoring intended to prevent overexposure to radiation, failure to report an over-exposure _ failure to evaluate airborne effluents, and failure to conduct contamination surveys as required.

Two items of noncompliance relating to evaluation of concentrations of radioactive materials in air in restricted areas and in effluents released to the unrestricted area were repetitive from the previous inspection.

Mr. A. B. Davis, Chief of the Fuel Facility and Materials Safety Branch, Region III, and Dr. John Cooper, Chief, Regional Licensing Section, discussed the items of noncompliance and the enforcement options available to the NRC with you and members of your staf f at the inspec-tion exit meeting on February 29, 1980.

The previous insp_ction of your licensed program, conducted on January 31 and February 2, 1979, identified seven items of noncompliance, and resulted in the issuance of an Immediate Action Letter and the conduct of an enforcement conference on March 23, 1979 in our Region III Office.

In response to the April 5,1979, Notice of Violation, Nuclear Pharmacy, Inc., replied in an undated letterveeceived in our Region III office on April 25, 1979, that the items would be corrected, that a greater amount of time would be dedicated to health physics and that compliance with NRC regulations would be achieved.

Your corrective actions have not achieved full compliance and we are concerned about what appears to be a disregard for radiation safety.

Consequently, to assure that appropriate and lasting corrective action is taken, we propose to impose civil penalties in the cumulative amount of Five Thousand Seven Hundred Dollars ($5,700) for the items of noncompliance set forth in Appendix A to this letter.

Appendix B.to this letter is the Notice of Proposed Imposition of Civil Penalties.

You are required to respond to this letter.

In preparing your response, you should follow the instructions in Appendices A and B.

In addition to your reply to the items set forth in the Notice of Violation, please describe the corrective steps which have been or will be taken to CERTIFIED MAIL RETURN RECEIPT REQUESTED 8007090lf[o

Your written reply to the flotice of Violation and the findings of our continuing inspections of your activities will be considered in determining whether f urther enforcement action such as additional civil penalties or orders to suspend, modify or revoke the license, may be required to assure f urther compliance.
