?LIASE TAKE NOTICE that Wisconsin's Envirennental Cecade, Inc. (" Decade") ,

requests a-hearing with regard to the Modification of November 30, 1979 Crder, dated April 4, 1980, in the above-captiened matter, pursuant to the previsien of said order which states in relevant part:

"Any persen whose interest may be affected by this Crder may within twenty days of the date of this Order recuest a hearing with respect to this Order."

In making this request, the folicwing three doct=ents in this docket pre-vicusly filed with the Nuclear Regulatory Cornission("C = mission") are hereby incorporated herein by reference as if set forth in full: (1) Request by the Decade for Hearing en Confira tory Crder and Memorandum in Support of Said Request, dated December 17, 1979; (2) Letter f cm K. M. Falk to H. R. Denten, dated January 8,1980; and (3) Answer of the Oecade in Cppesition to Staff Motien to Oeny Request for Hearing, dated Februa_-"y 22, 1980.

The affect of the instant crder en the Cecade and its members is as follcws:

The Cc=issien's Confirmatory Crder fer Modification of License, dated November 3C, 1979, states in relevant part at page 3:

"The licensee will not resume cperatien after the eddy current examin-atiens req-ded to be performed in accordance with ccndition 1(b) or 4 until the Oirector, Office of Nuclear Reactor Fegulatien, deterimine (sic) in writing that the results of such tests are acceptable." g N ,o 8006030 O M & .

The C:=ission's Macification of November 20, 1979 Crder, dated April 4, i

1980, provides the written finding of acceptability to permit Point Seach Unit 1 to resume cperation following the unit's 60 effective full pcwer day shut down for inspecticn,' as required in the Cc= mission's Noverter 30 Confirmatory Crder, notwithstanding the continued existence of corresien processes in the steam ,

genera:crs of the unit.

The Decade asserts the position of the American Physical Society that continued cperation of pressurized water reacters with significant steam generator tube degradation is a serious safety problem that could cause essen-tially uncoolable conditions in the course of a 1 css-of-coolant-accident.

It asserts this position on.its cwn behalf and cn behalf cf its merbers who reside throught the State of Wiscensin, including in proximity to the unit, and who would be adversely affected by such unceolable conditiens in terms of physical and psychological damage to their persen and icss of value to their hemes.

Therefore, the Cecade and its members =ay be injured by the decision set

. :th in the Cc= mission's April 4 Modification Crder to permit Pcint Beach Unit 1 to resume operation with degraded steam genesator tubes in the event the stated concern of the American Physical Society is correct.
