NRC STAFF MOTION REGARDING SCHEDULE FOR DISCOVERY In accordance with the Licensing Board's " Order Relative to Proposed New Schedule" (December 4,1979), final responses to discovery are to be filed by January 17, 1980.

There are presently outstanding between the NRC Staff and Friends of the Earth the following discovery:

1.

Second Set of NRC Staff Interrogatories to Friends of the Earth (F0E) (December 17,1979);

2.

First Set of Friends of the Earth Interrogatories to Nuclear Regulatory Comission Staff (December 17,1979);

ard 3.

Frienris of the Earth First Request for Production of Documents to the Nuclear Regulatory Commission (December 17,1979).

Counsel for the Staff and for F0E have mutually agreed to a one-week extension (until January 24,1980) for the filing of responses to this discovery.

-1/ Counsel for F0E has called to our attention that in its " Answers of Peti-tieners, Friends of the Earth, to First Set of Staff Interrogatories" (December 7, 1979), F0E stated several times that it was unable to respond pending completion of discovery." F0E inquired whether we believed an extension of the discovery period was required for the purpose of filing such supplemental responses.

The Staff believes that no such extension is necessary and that F0E should supplement its earlier responses as soon after receiving the Staff's responses to its discovery as possible.
