NRC STAFF MOTION FOR EXTENSION OF TIME By Memorandum dated September 10, 1979, the Appeal Board sought the views of the parties on whether the hearing on the aircraft crash probability issue should now be rescheduled, or if not, at what point should rescheduling next be considered.
Intervenors' Memorandum on the Resurrection of the Aircraft Crash Probability Issue was only received on October 11, 1979, having been misdirected within the Office of the Executive Legal Director as a result of the erroneous caption on the pleading.1/ Intervenors raise a number of matters in their Memorandum warranting consideration in the Staff's response to the Appeal Board, which may have a bearing on the Staff's position on rescheduling the hearing.
- Thus, although the Staff had intended to respond to the Appeal Board's Memorandum today as directed, more time will be necessary to fully consider Intervenors'
" observations".
Accordingly, the Staff requests an extension of time of five days in which to file '.ts response, that is, until October 17, 1979.
