h RESCHEDULING HEARING ON AIRCRAFT CRASH PR3BABILITY ISSUE g

By Memorandum of September 10, ~.979, the Appeal 30ard has solicited the views of the parties (1) on whether the hearing on the aircraft crash probability issue should be rescheduled, and (2) if not, when this question should next be considered.

On October 16, 1979, the Commission issued a Memorandum and Order directing the licensee's use of the EPICOR-II system to decontaminate intermediate-level waste water presently in the Three Mile Island Unit 2 (TMI-2) auxiliary and fuel handling buildings. The Comission's Order provided an opportunity for the licensee and any other person whose interest may be affected to request a hearing, emphasizing the need for expeditiously proceeding with such heartAg in light of the short-term nature of the EPICOR-II process.

If such hearing is requested, it will involve the same counsel for the Staff and likely the same counsel for the licensee and Commonwealth of Pennsylvania and representative of the Intervenors. Accordingly, the Staff recommends that the 2220

Appeal Board defer consideration of rescheduling the hearing on the aircraft probability issua at this time, for a period of thirty days. At that time, the Staff will be better able to evaluate the factors identified in Potomac Electric Power Company (Douglas Point Nuclear Generating Station, Units 1 and 2), ALAB-277, 1 NRC 539, 547 (1977), which we believe, have a bearing on whether going forward at this time is warranted. At that time, we will promptly advise the Appeal Board of our position on rescheduling the hearing.
