Licensing Board Notification Regarding Supplemental Information Being Provided to U.S. Nuclear Regulatory Commission Staff
Dear Administrative Judges:
In accordance with its obligation to inform the Licensing Board of relevant developments,1 Interim Storage Partners LLC (ISP) notifies the Board and the parties that it has located and is submitting to the U.S. Nuclear Regulatory Commission (NRC) Staff a previously unavailable portion of the 1997 ecological assessment submitted to Staff on September 4, 2019, as an enclosure to Letter E-55041.
As we advised the Board on September 5, 2019, ISP submitted Letter E-55041 to the NRC to provide supplemental information for ISP Environmental Report (ER) Chapter 3, Description of the Affected Environment. Specifically, ER Section 3.5.16 refers to six ecological studies, listed in five bullets, of the proposed Consolidated Interim Storage Facility area, and nearby areas referenced or described in ER Section 3.5. Letter E-55041 provided copies of, or ADAMS accession numbers for, those studies. One of those studies was the 1997 ecological assessment, which evaluated five sites. The raw data for one of those sites (site five), however, could not be located and thus, was not included in the copy provided to NRC Staff.
After contacting the author of the report, a copy of the data for site five was found. ISP is sending NRC Staff the data today by Federal Express. Because there is a pending motion before the Board to dismiss Sierra Club Contention 13, ISP makes this notification in parallel.

The Board and parties may view this document as relevant to Sierra Club Contention 13, the only contention admitted by the Board in its August 23, 2019 Memorandum and Order (LBP-19-7) ruling on intervention petitions and requests for hearing.
