TUGCO'S ANSWER TO CP&L'S MOTION TO COMPEL On April 20, 1979 Central Power and Light Company ("CP&L")

filed by mail a motion to compel TUGCO to provide further responses to CP&L's interrogatories. On March 28, 1979, TUGCO had filed both its answers to CP&L's interrogatories as well as its objections and motion for protective orders with respect to certain inter-rogatories and doc'iment requests. To the extent that TUGCO has already addressed interrogatories to which CP&L now demands further responses (i.e., Nos. 1, 2, 11, 12 and 13), in its objections and 1/

motion for protective orders, TUGCO stands on the same.-

There remain for response herein CP&L's demands for further responses to eight interrogatories (i.e., Nos. 3, 4, 5, 10, 14, 15, 22 and 23) to which TUGCO did not object. These eight interrogatories may be conveniently grouped into; formal-istic demands for separate responses on behalf of TP&L and DP&L

logistics of production (interrogatories Nos. 4, 5, 14 and 15) ;

and matters wherein CP&L is dissatisfied with the specificity or content of the response but TUGCO believes the response is sufficient and the requested responses would be redundant (interrogatories 22 and 23). ,

Formalistic Matters (Nos. 3 and 10)

The answers to interrogatories 3 and 10 are full and fair. The responses were made on behalf of all and each of the TU Companies. The Motion to Compel elevates form over substance and should be denied.

Logistics of Production (Nos. 4, 5, 14 and 15)

The answers to interrogatories 4 and 5 are complete.

With the production of the 11 recently executed contracts attached to the TU Companies' answer, CP&L has been given an opportunity to copy each of these contracts. The Motion to Compel should be denied.

As to interrogatories 14 and 15, the burden on CP&L is no greater than it would be on the TU Companies to search through files kept only in alphabetical order for chronological infor-mation. Consequently, the Motion to Compel should be denied.

Compare the Board's rulings declining to require preparation of maps which do not exist.

Redundant Demands (Nos. 22 and 23)

CP&L was a party to the federal court case and was present at all depositions taken in the case and throughout the trial. The actions of the TU Companies regarding attracting 2287 254

customers and their views on the maximization of coordination within ERCOT were discussed at length both a'c trial and in depositions. CP&L's proper course is to ask specific followup interrogatories, not repeat discovery it has already had.

The Motion to Compel should be denied.
