The Commission *, by a vote of 4-0 cpproved the Notice of Proposed Rule-Making to delete 520.304,as revised.

The Commission requested:

1.

that the text of tha Federal itegister Notice be revised to clarify (a) the fact that 520.304 has not been s end::d (except to the extent that Appendix C of 10 CFR Part 20 has been amended) since its adoption in 1957; and (b) that the proposed anendment was developed as part of an ongoing re--

examination of existing regulations on the disposal of low-level radioactive wastes;'(SD) (SECY Suspense: 11/17/78) 2.

that the Notice include a very brief description (if available) of the kinds of licensees who dispose of licensed material by burial in soil (outside a licensed low-level waste disposal facility), and an estimate of the number of such licensees; (SD)(SECY Suspense: 11/17/78) 3.

that "(llRC)" be inserted af ter "The Nuclear Regulatory Commission..." in line one of the Summary section of the Notice; that "llpC licensees to obtain" be inserted between "... to require" and "... Commission approval..." in line 2 of the Summary; and that " agrees that the existing practice should be revised, and" be inserted between "The Commission..." and "...

would like to obtain..." in the first line of the fourth paragraph of the Supplementary Information section of the flotice (page 3);

that the staff provide the Commission with its views on whether further NRC action is needed to assure adequate protection of the public health and safety from ine potential hazards of material already buried under the provisions of 520.304, to include answers to the following:

a)

Since Appendix C of 10 CFR Part 20 includes Am-241, '

Pu-239 and "any alpha emitter not listed," are the provisions of 520.304 consistent with NRC policies and regulations on disposal of wastes containing transuranic radionuclides?

b)

Is it possible to bury a transuranic waste under s20.304 that would be denied burial at a commercial waste burial ground?

c)

Does the staff intend to make available (in connection with publication of the proposed amendment) any document or technical report that presents calculations supporting the position that no public health hazard can exist from multiple disposal (under S20.304) in a single landfill?

SECY-78-564 - Approval Under Section 145b of the Atomic Energy _ Act of 1954, as Amended, for the Employment of James J. Cummings as Director, Of fice of Inspector & Auditor, and for an NRC "Q" Access Authorization

The Commission *, by a vote of 4-0:

1.

determined, pursuant to Section 145b of the Atomic Energy Act of 1954, as amended, that the employment of Mr. Cummings, and permitting him access to Restricted Data and other National Security Information, as required, is clearly consistent with the national interest; and 2.

approved granting Mr. Cummings an NRC "Q" access authorization before completion of his investigation by the FBI.
