INTERVENOR STATE OF OREGON'S MOTION FOR AN EXTENSION OF TIME IN WHICH TO FILE PETITION FOR REVIEW OF MARCH 21, 1979 DECISION (ALAB-531)

OF THE ATOMIC SAFETY AND LICENSING APPEAL BOARD I.

Intervenor State of Oregon, acting by and through the Energy Facility Siting Council ("EFSC") moves pursuant to 10 CFR 2.730 for an extension of time until April 17, 1979 in which to file, pursuant to 10 CFR 2.786, a pet;ition for review of the March 21, 1979 decision of the Atomic Safety and Licensing Appeal Board in this matter (ALAB-531).

This motion is made on the following grounds:

1.

The decision of the Atomic Safety and Licensing Appeal Board was served on March 22, 1979.

The attorney for the EFSC was on vacation from March 19, 1979 to March 25, 1979, and did not have a chance to review ALAB-531 until March 26, 1979.

2.

The members of the EFSC, as of March 28, 1979, have been sent copies of ALAB-531, but have not had an opportunity to review that decision.

3.

The EFSC is a citizen's commission which meets monthly.

It cannot make a decision on whether to seek review of ALAB-531 pursuant to 10 CFR 2.786 until its next meeting, to be held on April 10, 1979.

4.

Subject to the Commission's approval, the State of Gregon proposes to file its petition for review, if any, of ALiB-531 within one week of the April 10, 1979 EFSC meeting.

5.

The Affidavit of Richard M.

Sandvik in support of this motion is attached hereto.

AFFIDAVIT OF RICHARD M.

SANDVIK I, RICHARD M. SANDVIK, attorney for the Oregon Energy Facility Siting Council ("EFSC"), being first duly sworn, provide the following information with regard to the State of Oregon's motion for an extension of time in which to file a petition for review of the decision of the Atomic Safety aiid Licensing Appeal Board in this proceeding ( ALAB-531):

1.

The staff of the EFSC received a copy of ALAB-531 on March 26, 1979.

2.

The EFSC is an unpaid citizen body which meets once a month.

The members have been sent copies of ALAB-531.

3.

The EFSC is scheduled to meet next on April 10, 1979, at which time its technical staff and legal counsel will pre-sent an analysis of ALAB-531 and will recommend possible courses of action in response thereto, including seeking Com-mission review under 10 CER 2.786.
