MOTION OF HOUSTON LIGHTING & POWER COMPANY FCR EXTENSION OF TIME WITHIN WHICH TO RESPOND TO CENTRAL POWER & LIGHT COMPANY'S ANSWERS AND OBJECTIONS TO HOUSTON'S FIRST 3FT OF WRITTEN INTERROGATORIES AND CENTRAL POWEJ & LIGHT COMPANY'S RESPONSE TO HOUSTON'S FIRSP REQUEST FOR PRODUCTION OF DOCUMENTS In accordance with Section 2. 711 of the Commission's Rules of Practice, 10 C.F.R. S2.711, Houston Lighting & Power Company (Houston) hereby respectfully moves this Board for an extension of time from April 5, 1979, until April 19, 1979, in which to review answers and objections of Central Power & Light Ccmpany (CP&L) to Houston's first set of written interrogatories and CP&L's response to Houston's first request for production of documents and to respond to CP&L's objections thereto.

On February 6, Houston served on CP&L both HOUSTON LIGHTING & POWER CONPANY'S FIRST SET OF WRITTEN INTERROGATORIES TO CENTRAL POWER AND 790413 OG 'f/

LIGHT COMPANY and HOUSTON LIGHTING & POWER COMPANY'S FIRST REQUEST FOR PRODUCTION OF DOCUMENTS TO CENTRAL POWER & LIGHT COMPANY.

Purcuant to informal agreement between Houston and CP&L and to this Board's February 28 Order, on March 26 CP&L served CENTRAL POWER AND LIGHT COMPANY'S ANSWERS AND OBJECTIONS TO HOUSTON LIGHTING

& POWER COMPANY'S FIRST SET OF WRITTEN INTERROGATORIES TO CENTRAL POWER AND LIGHT COMPANY and CENTRAL POWER AND LIGHT COMPANY'S RESPONSE TO HOUSTON LIGHTING & POWER COMPANY'S FIRST REQUEST FOR PRODUCTION OF DOCUMENTS TO CENTRAL POWER AND LIGHT COMPANY.

Pursuant to Section 2.740 (f) the Commission's Rules of Practice, 10 C.F.R. S2. 740 ( f) , Houston would be permitted on or before April 5, 1979, to move the Board for an order compelling CP&L to respond to Houston's interrogatories and requests for production of documents.

However, CP&L's answers and produced documents are quite extensive. To Houston's 59 interrogatories, CP&L has responded with answers or objections totalling 56 pages, and has attached another 235 pages of documents. In addition, CP&L has offered to make available for inspection and copying documents as identified in its answers and objections to Houston's interrogatories. CP&L also indicated that it would prepare an index of privileged documents. Because of the volume and technical nature of these materials, Houston will be unable to review CP&L's production and determine whether a motion to compel is required by the April 5 deadline. Houston hopes, however, that it and CP&L can complete

the review process and discuss -- and resolve -- any disagreements over CP&L's production by April 19, 1979. If CP&L and Houston are not able to reach informal agreement by that date, however, Houston does not wish to be precluded from invoking Section 2.740 (f) of the Commission's Rules of Practice to obtain the full responses to its discovery request to which it believes it is entitled.

Houston is authorized by counsel for CP&L to state that CP&L does not object to the extension of time requested herein.

Wherefore, Houston Lighting & Power Company, pursuant to 10 C.F.R. S2.711, respectfully moves for an extension of time until April 19, 1979, in which to respond to CP&L's answers and objections to first set of written interrogatories and CP&L's response to its first request for production of documents directed to CP&L by Houstria, and, if necessary, move to compel CP&L to provide fuller responses thereto.
