Dear Mr. Cochran:

This is in further response to your letter of November 23, 1977 in which you requested, pursuant to the Freedom of Information Act, a copy of all records received, considered or approved by the NRC or its Commissioners, that were used by the staff in preparing the Draft Safeguards Supplement prepared in connection with the GESMO proceedings.

Portions of document 1 of Appendix A have been classified pursuant to Executive Order 12065 and are being withheld from public disclosure pursuant to exemption (1) of the Freedom of Information Act (5 U.S.C.

552(b)(1)) and 10 CFR 9.5(a)(1)) of the Commission's regulations.

Portions of document 2 of Appendix A contain information which is confi-

dential business (proprietary) information and are being withheld from public disclosure pursuant to exemption (4) of the Freedom of Information Act (5 U.S.C. 552(b)(4)) and 10 CFR 9.5(a)(4) of the Conmission's regulations.

The non-exempt portions of documents 1 and 2 are being placed in the Public Document Room 1717 H Street, N.W., Washington, DC.

Pursuant to 10 CFR 9.9 of the Commission's regulation, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the under--

signed and William J. Dircks, Director, Office of Nuclear Material Safety and Safeguards.

This denial may be appealed to the Commission's Executive Director for Operations within 30 days from the receipt of this letter.

As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555 and should clearly state on the envelope and in the letter that it is an " Appeal from an initial F0IA Decision."
