This is to provide a followup report to our letters dated flovember 6, 1978 and January 3, 1979 on the status of General Atomic's license application XSNM01229 for the export of low-enriched uranium to Taiwan, As you are aware, this application has been subject to extensive review by f1RC, including receipt of additional material frem the Executive Branch, in view of the need to examine several questions concerning the ROC's nuclear Drogram which directly affect the Comission's bases for determining that the proposed export meets the statutory export approval criteria. The Comission was well along in resolving these questions when the President announced his. decision to break diplomatic relations with the Republic of China. Unavoidably, this decision has raised several fundamental questions concern h the legal basis for future U.S. nuclear cooperation with Taiwan, which are being actively addressed. The Comission is seeking further clarification by the Executive Branch of this matter, including the effects of the President's decision on flRC's nuclear export licensing responsibilities with respect to Taiwan - in particular whether it affects the Comission's ability to make the statutory findings required by the Atomic Energy Act and the fiuclear fionproliferation Act. Another factor to be considered in this connection is the Congressional view of continued cooperation with Taiwan. As you may know, the Execuilve Branch recently forwarded to Congress proposed legislation to clarify the basis for continued cooperation with Taiwan. The Comission is considering the impact of this on its review of exports to Taiwan.
