Gentlemen:

This is the February 1979 progress report of Houston Lighting & Power Company.

February was a busy month for Houston. On February 7, Houston received a Motion to Compel Fuller Responses from the Department of Justice. By the Board's Order of February 15, Houston has until March 5 te respond to th2s motion. Houston is working on that responst.

On February 9, Houston served second sets of inter-rogatories on both the Department and the NRC Staff. Houston sought to learn from both the Department and the Staff the names of all prospective witnesses which each anticipates calling and certain further information concerning expert wit-nesses, a permitted by the NRC Rules of Practice.

The NRC Staff responded informally on February 26, and, pursuant to the Board's Order of February 27, is scheduled to answer or object to these interrogatories by March 12.

Houston responded to this n.otion on February 27.

Houston filed answers and objections to interrogatories from the NRC Staff on February 20, and filed a corresponding motion for a protective order on February 22.

Houston received a second set of interrogatories from Central Power & Light Co. (CP&L) on February 23. During the month Houston agreed that CP&L could have a 30-day extension in responding to Houston's interrogatories, until March 23.

On February 28, Houston learned that Judge Porter's Memorandum Opinion in West Texas Utilities Co., No CA3-76-0663-F (N.D. Texas, January 30, 1979), has become final as of February 27 with only typographical errors corrected.

Finally, Houston has been preparing answers end objections to interrogatories from the Public Utility Board of Brownsville.

This response is due March 7. During the month Houston has continued to provide informal discovery to the Department, the Staff, and other parties when so requested.
