Dear Mr. Roisman:
This letter responds to your appeal, dated January 5, 1979, of the denial of two documents under the Freedom of Information Act.
This is to inform you that the Commission has granted your appeal on one docu-ment and determined it to be moot as to the other.
As to the former document, the draft memorandum for the Commission from James L. Kelley, the Commission has decided that this document should be released in its entirety.
A copy of it is attached.
As to the latter document, a memorandum for T. Rehm from M.E. Chopko, dated August 1, 1978, the Commission has found that this document was inadvertently designated as withheld. This document was in fact released to you on November 15,1978 (Document 78 of Appendix A of the letter from Felton dated 11/15/78), and should not have been listed in the January letter at all.
This letter constitutes the final agency action on your request.
