Gentlemen:

  1. A On January 15, 1979, the Licensee in the captioned proceeding filed a ' Motion f

to Strike Documents Accompanying Petition for Stay Filed by Coalition for Safe g2 Power. " The basis for the Licensee's motion is that the inclusion in the stay request of the documents which are the subject of the motion appears to be an y['s attempt to circumvent the page limitation of 10 CFR $ 2.788. The Staff had a p

similar concern and, on January 15, 1979, filed a motion requesting that the entire application for stay by the Coalition for Safe Power be stricken or, alternatively, that the Staff be perrnitted to file a response exceeding the page limitations of Section 2.788.

e In view of the Licensee's statement in its motion that it is confident that its response to the stay application is adequate despite the fact that the Licensee j

was constrained to limit its response to 10 pages, and in view of the Appeal j

Board's Order of January 18, 1979 permitting the Staff to file a response *.o the stay application exceeding 10 pages, the Staff does not intend to file a
