Duke Power Company, Dkt. No. 70-2623 Gentlemen:
By letter dated December 22, 1978, the Staff transmitted to the Applicant 10 copies of the Environmental Impact Appraisal with respect to the transfer and storage of spent fuel from Oconee at McGuire Nuclear Station.
For reasons known only to the Staff, no copies of this appraisal were served on any of the parties to the Duke-proceeding.
This failure by the Staff will increase by at least 10 days, maybe more, the time needed to bring this case to hearing, since all parties must be allowed equal time to study the environmencal impact appraisal.
We request that the Board admonish the Staff to serve this document as quickly as possible and, in future, to follow the accepted practice of simultaneous service on all parties of communications between Applicant and Staff..
