Dear Mr. Shea:

This letter is in response to your letter dated July 21, 1978, requesting Executive Branch views as to whether amend-ment of an export license in accordance with the application hereinafter described would be inimical to the common defense and security of the United States and whether the proposed export meets the applicable criteria of the Atomic Energy Act of 1954, as amended, and the Nuclear Non-Proliferation Act (P.L.95-242):

NRC No. XR-122 -- Application by Westinghouse Electric Corporation to amend license XR-122, authorizing export of a 2785 megawatt thermal, pressurized water reactor to Spain, to include Zquipos Nucleares, S.A., Maleano-Santander, Spain, as an intermediate consignee for addi-tional machining of certain reactor parts prior to delivery at the job site.

The proposed export, as amended, would take place pursuant to the Agreement for Cooperation Between the United States and Spain as confirmed in a letter from the Embassy of Spain dated October 25, 1978.

Spain has adhered to the provisions of its Agreement for C; operation with the United States.

The Executive Branch has reviewed this application and concluded that the' requirements of the Atomic Energy Act and P.L.95-242 have been met and that the proposed export, as amended, will not be inimical to the common defense and security of the United States.

A detailed analysis is be-lieved unnecessary in this case because of the minimal change to the terms and conditions of the original export license.

In response to your letter of September 6th, I am pleased to inform you that confirmation has been received from'the Spanish Junta de Energia Nuclear regarding the following particulars:

1.

The transfer of the equipment, as identifiec on License XR-122, will be subject to all the terms and conditions of the current Agreement for Cooperation concerning civil uses of atomic energy between the United States and Spain.

2.

The intermediate consignee, Equipos Nucleares S.A.,

is authorized to' receive and possess the material.
