This is in response to your request dated December 5,1978 for an exemption to 10 CFR 70.51(e)(3) which would allow latitude in beginning dates for physical inventories fo* low enriched uranium and 10 CFR 70.58(i) which would allow Babcock & Wilcox to store certain forms of scrap which are measured with an uncertainty greater than i 10% for a period longer than one year.
We have determined that the granting of your requests will not endanger the common defense and security and is otherwise in the public interest. Accordingly, License Condition 5.4 of Amendment MPP-2 to your License SNM-ll68 is hereby added, effective immediately, to read as follows:
5.4 "Notwithstanding 10 CFR 70.51(e)(3)(ii), at a to allow for physical inventories to be conducted during plant shutdowns for cleanout and for enrichment changes, physical inventories taken in accordance with 10 CFR 70.51(f)(1) shall be conducted to begin at a date scheduled by the licensee within the month of January and the month of July each year".
In addition, a new License Condition 4.12 is also added to read as follows :
4.12 "Notwithstanding the requirements of 10 CFR 70.58(i)(2), scrap and waste in the form of contaminatsd oil which was locally generated prior to December 31, 1978 and which was measured to an* uncertainty exceeding 110% shall be disposed of not later than December 31, 1978".

. We have determined that the attachments to your letter dated December 5,1978 contain information of a type specified in 10 CFR 2.790(d). Accordingly, pursuant to Section 2.790(d)(1), such information is deemed to be commercial or financial information within the meaning of 10 CFR 9.5(a)(4) and shall be subject to disclosure only in a.ccordance with the provisions of 10 CFR 9.12.
