(Davis-Besse Nuclear Power Station,) NRC Docket Nos. 50-500A Units 2 uid 3) ) 50-501A APPLICANTS' RESPONSE TO THE MOTION BY THE CITY OF CLEVELAND On January 29, 1980, the undersigned counsel forwarded to the Secretary of the Commission, with copies to the five Com-missioners, two press releases (announcing the decisions of the Davis-Berse 2 & 3 and Erie 1 & 2 co-owners to terminate plans to construct and operate those units) and a recent decision entered by United States District Court Judge Krupansky. In a notion dated February 5, 1980, the City of Cleveland has moved to strike these documents . Cleveland's motion is misdirected and the relief sought should be denied by the Commission.

Turning first to the press releases, it long has been Commission practice that, if an applicant utility makes a decision 8002150

to defer or cancel a planned unit, such information is trans~

mitted to the adjudicatory bodies of the Commission before whom cases involving the affected units are pending. That is what was done here. The propriety of such action is confirmed by a letter received on January 30, 1980, from the Secretary to the Appeal Board Panel advising counsel that Mr. Rosenthal believed it appropriate that Shaw, Pittman provide the press release in-formation "directly to the Commissioners. "

Nor was there anything inappropriate in transmitting for the Commission's information the opinion of Judge .*rupansky.

The forwarding of additional authorities to a reviewing court is a well-accepted practice. Indeed, the General Rules of the United States Court of Appeals for the District of Columbia authorize the precise procedure followed here by Applicants. Rule 8(g) states:1!

When pertinent and significant authorities come to the attention of a party after his brief (or memorandum on a motion) has been filed, or after oral argument but before decision, a party may, without obtaininc special leave of court, supple-ment his brief by letter to the Clerk of this Court, furnishing 3 extra copies to the Clerk, and copy to adversary counsel, setting forth the citations. There shall be a reference either to a page of the brief or to a point orally argued to which the citations pertain, but the letter shall contain no argument or explanations. Addi-tional authorities must be submitted not less than 10 days prior to oral argument unless they were published within the 10-day period. [Em-phasis added.]

requirements. There was no argument, but only a brief reterence to the issue to which the Krupansky opinion pertained. This is entirely proper.

If there still romains doubt as to the propriety of the procedure used by Applicants, we respectfully request leave to file the court opinion and two press releases.
