U. S. Nuclear Regulatory Commission January 16, 1980 The contents listed above fall within the boundaries of other contents approved by Certificate of Compliance 9044. All caterial is in solid form.

Containment is assured by the cethod of packaging; namely, cncapsulating material in closed metal containers, caterial being in solid form, and being capped by concerete in a sealed dru: neeting the requirements of a Specification 17H container. The decay heat and U-235 l

content are each only 70% of other approved contents. Since the above described contents are well within the scope of the license, we believe that contents 5.(b)(1)(v) should be considered a permanent section of the license.

This request is made necessary by the delays r'esulting from the national radioactive waste disposal problem.

Your rapid processing of this request will reduce the potential for curtailed production of critical medical radioisotopes. Your prompt attention will be truly appreciated.

I Pursuant to 10 CFR 170.31.11.B, we are attaching a check in the amount of $2,800.00 for the minor acendment.

Yours very truly, m
