Dear Governor Clinton:
Your letter of November 26, 1979, to Commissioner Hendrie has been referred to me for reply. You requested our cooperation on five specific items. Each of the items is related to notification and assistance to Arkansas State agencies in matters pertaining to emergency planning or possible incidents at the Arkansas Power and Light Company Nuclear Power Station.
In response to your request that in the event of an incident the NRC assist the State in evaluation beyond the excP sion area please be advised that since 1961, the NRC has been a signat 'i o the Interagency Radiological Assistance Plan (IRAP) of 13 Federal nyencies who have agreed to provide rapia and effective radiological assistance in the event of a peacetime radiological incident. The response of Federal agencies, including NRC, to the incident at Three Mile Island demonstrates the extensiveness of the available assistance. Please be assured that, in the unlikely event of an incident in your State, there would be a similar response.
In proceeding to honor your request that Mr. E. Frank Wilson, Director, Division of Environmental Health Protection, Arkansas Department of Health, be placed on our mailing list, we detennined that since May 1979, Mr. Wilson has been listed with the NRC Office of State Programs as the Arkansas State Liaison Officer and consequently is the single point of contact within your State through which all pertinent information is channeled. Additionally, you stated that the Governor's Office was not notified of our emergency planning meetings in Las Vegas and Russellville, Arkansas.
In checking, we established that both Mr. Wilson and Mr. Lee Epperson, your Director of the Office of Emergency Services had been notified prior to the meetings and, in fact, both attended the meetings in question. We encourage and endorse the involvement of a Governor's staff in these activities, and respectfully suggest that your staff and your State Liaison Officer work out the necessary coordination.
In regard to your request that either your office, or the appropriate State agency, be advised in all matters having a potential effect on the health and safety of the citizens of Arkansas, you will be pleased to know that cne of the key items in our review of emerger.cy planning is to insure that the mechanisms for such notification exists. The NRC guidance document titled " Emergency Action Level Guidelines" (NUREG-0610) requires that in each category of event, including the very lowest level, the specified first action of the licensed utility, is to promptly inform the State and local authorities of the nature of the event or unusual condition as ston as it is discovered. We trust that this specification answers your concerns.
