Dear Lyman:

This will confirm our telephone conversation this afternoon in which I agreed (1) that Licensee will make no objection to your November 23 Motion to Permit Delayed Filing of Interrogatories and (2) that your time for filing additional TMI-related contentions is extended to December 10, 1979. NRC counsel has advised me that he has no objection to these extensions of time.

On your part you agreed on behalf of the Joint Intervenors that Licensee could defer answers to the following sets of inter-rogatories contained in your November 23 interrogatory request:

Sets 1 and 2 (Need for power and power costs)

Set 17 (Emergency plans)

Set 19 (Fuel element assembly guide wear)

Our answers to these interrogatories will b e filed after Licensee has filed, respectively, supplemental materials with NRC updating data on power needs and costs, transmitting State emergency plans, and providing a resolution to the guide wear problem. The stipu-lated time for answers or objections to these interrogatories will run from the date of the supplemental filings in question.
