Appendix A NOTICE OF VIOLATION Reliable Electric Company License No. 12-12675-01 License No. 12-12675-03E Based on the inspection conducted on November 8 and 13, 1979, it appears that certain of your activities were in noncompliance with NRC require-ments, as noted below.
Item 1 is an infraction, and items 2 and 3 are deficiencies.
Items 1 and 2 refer to License No. 12-12675-01.
Item 3 refers to License No. 12-12675-03E.

License Condition No. 15 of Byproduct Material License No. 12-12675-01, states, in part, the licensee shall possess and use licensed material in accordance with statements, representations, and procedures contained in application dated September 26, 1978, in which certain surveys are specified.
Contrary to these requirements, since April, 1979, to the date of this inspection, leak testing of, and storage area surveys for, the SR type, surge arrester gas tubes containing nickel-63, have not been performed as required.

Paragraph 10 CFR 401(a), Title 10 of the Code of Federal Regulations, Part 20, states, in part, each licensee shall maintain records showing the radiation exposure of all individuals for whom per-sonnel monitoring is required.
Such records shall be kept on Form NRC-5 or on clear and legible records containing all the information required by Form NRC-5.
Contrary to this requirement, from March, 1979, to the date of this inspection, personnel monitoring records were not complete; :;ocial security numbers and birth dates of the individuals badged were not included in the licensee's records.

Paragraph 10 CFR 32.16, Title 10 of the Code of Federal Regulations, Part 32, states, in part, each person licensed by the NRC to trans-fer for sale or distribution, items containing byproduct material, shall file an annual report which shall include:
(a) a description of each product; (b) for each radionuclide in each type of product, the total quantity of the radionuclide; and (c) the number of units of each product transferred during the report period of the year ending June 30, and shall be filed within 30 d:/s thereafter.
Contrary to this requirement, from July 31, 1979, to the date of this inspection, no report for the year ending June 30, 1979, had been submitted to the NRC as specified by 10 CFR 32.16.
