RES PONSE IN SUPPORT OF THE MOTION OF THE DEPARTMENT OF JUSTICE FOR MODIFICATION OF THE JULY 24, 1979 ORDER OF THE ATOMIC SAFFTY AND LICENSING BOARD The Public Utilities Board of the City of Brownsville, Texas ( "Brownsv ille " ) wishes to state its support for the additional discovery period requested by the Department of Justice.

Brownsville could, albeit with :onsiderable dif-ficulty, proceed on the schedule in the Board 's July 24, 1979 Order, completing discovery by the end of December 1979 and.

complying with the other procedural dates.

An additional period for completion of discovery, however, would allow Brownsville and other parties a more thorough preparation in advance of hearing, and would be in the public interest.

In addition to the justifications for an additional period presented in the Department of Justice's Motion, Brownsville would like to bring additional facts to the Board's attentions.

. have taken several weeks to be produced.

Thus depositions of Measrs. Price, Durham and Siegelin (present and former employees of Central Power & Light Company) were taken on October 2 and 3,1979, but the transcripts were not ready until December 3, 1979.

Brownsville cannot afford to send an attorney to all depo.sitions, and is often dependent on such transcripts to prepare its case.

In addition, a number of documents designated for pro-duction in February and March 1979 have not yet been produced by CP&L despite Brownsville's repeated requests, and frequent reassurances by CP&L.

Brownsville and the other smaller parties will necessarily be dependent in part upon the concerns presented by Justice and Staf f, simply as a matter of economics.

Were Brownsville forced to duplicate that effort, the cost of doing so might end competition nearly as effectively as the acts at issue here.

Consequently, Brownsville believes that af fording governmental parties adequate time to prepare their case is in the public in te re s t.

The Department of Justice does not stand to gain by provoking delays, and should be allowed the time it needs to do its job.
