20555 In the Matter of Houston Lighting & Power Company (Allens Creek Nuclear Generating Station, Unit 1)

Docket No. 50-466 Gentlemen:

In the Board's Order of November 19, 1979 concerning matters discussed and decided at the ACNGS October 15-19, 1979 prehearing conference, it appears that clarification of one part of the Order would be helpful.

On page seven of the Order, in footnote four, reference is made to certain contentions of Mr. Doherty which were either tne subject of stipulation or were withdrawn.

It is stated in the footnc+9 that contentions 18, 20, 26, 29, 33, 34, 37 and 39 were withdrawn by Mr. ;oherty.

It is our understanding that Mr. Doherty withdrew only the criai'nal contentions 20, 26, 29, and 33, and that the amended contentions 29 (as limited), 33, and 39 remain for decision by the Board (amended contentions 20 and 26 having been admitted t'y stipulation).

It is our further understanding that both the original and amended contentions 18, 19, 34, and 37 were withdrawn by Mr. Doherty.

I 'believe that the transcript references indicated in the Order will support this explanation.

Sincerely,

/L'sw Colleen P. Woodhead Counsel for NRC Staff cc:
