REPORT OF THE DEPARTMENT OF JUSTICE - OCTOBER, 1979 Pursuant to the Order dated June 21, 1978, issued by the Atomic Safety and Licensing Board (" Board"), the Department of Justice (" Department") submits this report on the progress made in completing discovery during the month of September, 1979.

During the month of September, the Department was involved in a heavy deposition schedule. The Department deposed:

The Department wishes to bring to the attention of the Board an October 4,1979 letter f' rom the City of Austin. This letter could be interpreted to indicate that the depositions of Peterson, Rummel and Hancock were taken on November 1 and 2, 1979 instead of their original dates in October, due to an attempt by the Department to delay the proceedings. The Department wishes to make it clear that it has diligently pursued discovery and has cooperated in modifying the deposition schedule where possible for the convenience of other parties. We regret that the City of Austin could not accommodate the Department on this occasion wi thou t inferring to the Board that the Department was attempting to delay. The limited participation by the City of Austin in the deposition program to date, no doubt contri-buted to its lack of appreciation of sche,duling problems that all parties have confronted and the Depar tment's record of attempting to resolve these problems, where possible, on an amicable basis.

The Department initially requested that the City of Austin agree to a change of the original depositions dates for Peterson, Rummel and Hancock due to scheduling difficulties. These depositions were, however, taken by the Depar tment on October 9-10 as originally scheduled, although the document production was moved forward from October 5 to Octooer 8.

New staff changes have also been made at the Department this month. Ron Clark lef t the Department to begin practice with the firs t of Sidley and Austin. Nancy Luque has joined the Departments' staf f from the Of fice of the Chief Counsel, State of California Social Services Department.
