Dear Mr. Fialka:

This is in further response to your letter dated November 30, 1978, in which you requested, pursuant to the Freedom of Information Act (F0IA),

access to all documents pertaining to the Nuclear itaterials and Equipment Corporation, and NRC's investigation into the remarks of the Executive Director for Operations that had been denied in whole or in part in response to previous FOIA requests.

The Nuclear Regulatory Commission and the Department of Energy have now completed their reviews of document 18 of Appendix A to Mr. J. M. Felton's letter dated August 17, 1979 and enclosed are the releasable portions of this document.

The non-released portions of this document contain information classified pursuant to Executive Order 12065.

This information is being withheld from public disclosure pursuant to Exemption (1) of the Freedom of Information Act (5 U.S.C. 552(b)(1)) and 10 CFR 9.5(a)(1) of the Commission's regulations.

Pursuant to 10 CFR 9.9 of the Commission's regulation:;, it has been determined that the information withheld is exempt from production or disclosurc, and that its production or disclosure is contrary to the public interest.

The persons responsible for this denial are the under-signed and Mr.,Raymond J. Brady, Director, Division r# Securi ty.

This denial may be appealed to the Commission's Ex autive Director for Operations within 30 days from the receipt of this letter.

As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that' it is an " Appeal from an Initial F0IA Decision."
