Motion For Approval Of Stipulation The Nuclear Regulatnry Commission Staff (" Staff")

hereby moves the Atomic Safety and Licensing Board (" Board")

to enter an Order pursuant to 10 C.F.R.

S 2.753 approving the attached stipulation identified as 3xhibit A.

Consumers Power Company (" Consumers") and Christa-Maria have authorized the Staff to advise the Board that they, as signatories of the attoched stipulation, join in this motion.

In support of its rcotion, the Staff states as follows:

1.

The NRC Staff, Consumers and Christa-Maria met on November 14, 1979 pursuant to the Board's direction in its Memorandum and Order of September 25, 1979 to reach some agreement con-cerning the admissibility of the contentions filed by Christa-Maria on October 30, 1979.

A " Restatement of Contentions" was filed.on November 20, 1979.

As shown by the stipulation, the parties were able to agree with respect to:

1) the admissibility of Christa-Maria's Contentions Nos. 2 and 3; and 2) the conditional withdrawal of 1522 150 7 012 0700C)G? bf G

Contentions Nos.

4, 5, and 6.

The stipulation also reflects the lack of agreement between the parties as to the admis-sibility of Christa-Maria's Contentions Nos.

1, 7,

8, and 9.

The objections of the NRC Staff and Consumers to these con-tentions will be made in separate pleadings to be filed on November 29, 1979.

Approval of this stipulation is deemed appropriate since it will aid in the orderly administration of this proceeding without compromising the rights of the parties involved in the proceeding.

For the reasons stated above, this motion should be granted.
