Dear Mr. Gannis:

This is in further response to your letter dated September 6,1979, in which you requested, pu: suant to the Freedom of Iuformation Act, information on a number of topics i..:luding one concerning the disposal of radioactive wastes.

At the time our November 5,1979, letter to you was being prepared and dispatched, we were unaware that simultaneously two additional documents concerning your request were being identified, duplicated, and sent to this office from one of our offices located in another building some distance away from us. After we dispatched our November 5,1979, letter to you, we received the two additional documents, copies of which are enclosed. The first document is dated September 11, 1979, and is titled:

Testimony of Joseph M. Hendrie, Chairman, U.S. Nuclear Regulatory Commission Before the Senate Committee On Environment and Public Works (20 pages).

The second <iocament, technically is not subject to your request because it is a document which was produced after the date of receipt of your F0IA request, hence it was not an agency record subject to the F0IA at that time.

However, a courtesy copy of this document (4 pages) is enclosed in order to provide you with the latest information on this subject. This second document, a Notice of Proposed Rulemakirg, is a copy of the NRC's notice to the public published in the FEDERAL REGISTER, on October 25, 1979, at 44 FR 61372-75, titled:

" Storage and Disposal of Nuclear Waste".

Copies of these two additional documents will also be placed in the NRC Public Document Room (PDR), located at 1717 H Street, N.W., Washington, DC.
