Dear Dr. Morris:

Metropolitan Edison Cc=pany filed an application, dated May 1,1967, for a construction permit and operating license relating to its proposed Three Mile Island Nuclear Station Unit 1.

The Three Mile Island nuclear Station is scheduled for ce=ercial operation on May 1,1971. The availability of the plant on May 1,1971 is required to assure that Metropolitan Edison Co=pany vill have sufficient plant c'apacity to meet its requirements and those of the General Public Utilities Systen and the Pennsylvania-Uev Jersey-Varyland (PJM) pool with which the applicant is associated.

To assure the availability of the power plant on schedule, the applicant respectfully requests, pursuant to Section 50.12 of the AEC regulations, an exe=ption from the provisions of Section 50.10(b) to permit, prior to the issuance of a construe-tion permit the pouring of concrete for the tendon access gallery which vill be located below the nain contaiment =at. A general cross section of the plant shev-ing the tendon access gallery appears in Figure 1-8 in Section 1 of Volume 1 of the applicant's Preliminary Safety Analysis Report. The tendon access gallery vill be approxi=ately 8 feet deep and 4 feet vide with a vall and slab thickness of approxi-mately 12 inches. The containment structure dees not depend upon the access gallery for support.

The exe=ption is required in order to per=it the applicant to proceed with certain other pre-construction verk which is permitted pursuant to the provisions of 50.10(b), i.e. the pouring of the concrete =ud =at to previde a verking surface in the botten of the reacter building excavation and the placement of reinforcing bars for the reactor building base slab. The rein'crcing bars vill not be attached er affixed in any per=anent way to the valls or the floor of the excavatien.

The granting of the exe=ption vill not endanger the health and safety of the public and vill not be inimical to the ec=on defense and security. In view of the public interest to be served by assuring the availability of the Three Mile Island Nuclear Station Unit 1, when scheduled, the applicant requests that the exe=ption be granted as proposed.
