Dear Congressman Jones:

Thank you for your memorandum of April ll,1979 to Mr. Carlton Kammerer, Director, Office of Congressional Affairs, regarding matters raised by your constituents concerning Public Service Company of Oklahoma's pro-posed Black Fox Station. Your memorandum was referred to this office for response.

The matters raised by your constituents concern principally:

(1) the con-tinued construction and operation of nuclear power plants in light of the accident at Three Mile Island Nuclear Station, Unit 2; (2) the development of alternative methods of energy production, such as solar; and (3) oppor-tunity for public participation in the issuance of National Pollutant Dis-charge Elimination System (NPDES) Pennit OK0034614 for the proposed Black Fox Station.

In addition, you requested an updated report on the proposed Black Fox Station as well as a schedule of public hearings held or to be held.

With respect to the continued construction and operation of nuclear power plants in light of the accident at Three Mile Island, we have taken or are taking a number of actions with respect to all nuclear power plants to ensure the continued protection of the health and safety of the public.

Specifically, full-time inspectors have been assigned to each operating plant utilizing Babcock & Wilcox pressurized water reactors like those at Three Mile Island.

In addition, the licensees of all these plants which were not already shut down have voluntarily shut down their plants. We have issued confirmatory orders to the licensees of all Babcock & Wilcox reactors like those at Three Mile Island to assure that necessary plant modifications, additional training and revised operating procedures will be effected prior to resuming operation.

Licensees of all operating plants utilizing pressurized water reactors have been instructed to take specific actions with regard to the status of certain equipment, plant procedures, operator actions and facility designs. Licensees of all operating plants, including those utilizing 7 7 #7.n #5r

boiling water reactors, have been instructed to provide us with additional infomation with regard to their facilities in light of the Three Mile Island accident.

In addition, substantial effort is being expended within this agency to evaluate the factors which contributed to the Three fiile Island accident and to prevent a similar occurrence in the future.

We will carefully review all the information obtained and developed as a result of the Three Mile Island accident and take whatever further action is deemed appropriate.

With respect to alternative methods of energy production, such as solar, the Department of Energy is the Federal Agency' responsible for their re-search and development. Our consideration of alternative methods of energy production involves a comparison of the environmental impact of each nuclear power plant with other energy alternatives as part of our over-all review of each utility's application for a construction permit or an operating license under the National Environmental Policy Act. To-date, we have determined that alternative methods of energy production, such as solar, are neither technically nor economically feasible to provide the required amount of power in the time frame in which it is needed.

With respect to NPDES Permit OK0034614 for the proposed Black Fox Ctation, the Environmental Protection Agency is the Federal Agency responsi a for its issuance and for providing opportunity for public participation therein.

Our involvement with the issuance of NPDES Permits is limited to the assess-ment of the environmental impact of each nuclear power plant as part of our overall review of each utility's application for a construction pemit or an operating license.

As part of our National Environmental Policy Act review of a license application, we analyze and evaluate the potential impact of station discharges on the aquatic environment. This review is coordinated with the Environmental Protection Agency regional office or the State agency having responsibility for issuance of the NPDES Pemit.

We solicit and usually receive coments or other input from such agencies prior to issuance of our Draft Environmental Statenent. We also solicit and usually receive comments from the same agencies on the Draft Environ-mental Statement. These coments are incorporated in our Final Environ-mental Statement.

Utilities must also have a 401 Certification (under Section 401 of the Federal Water Pollution Control Act) prior to issuance of a 71 cense. Re-strictions imposed on a nuclear power plant to protect the ac"atic environ-ment from non-radiological discharges are specified in the F. 0ES Permit and the 40i Certification.

In this regard, we are precluded from adding conditions of our own by Section 511(c) of the Federal Water Pollution Con-trol Act.

In the event that the environmental statement process results in the iden-tification of potentially significant impacts due to non-radiological dis-charges, we rely on the NPDES Permit cuthority to determine apprcpriate

investigative action. However, despite the fact that another agency has primary jurisdiction for controlling non-water-borne effluents, we still consider the environmental impact'of these discharges in the overall balancing of environmentar impacts in reaching a decision of whether to issue a license.

We are enclosing a copy of the draft of NPDES Permit 3K0034614 that we have on file. This draft is interpreted as evidence that the Environmental Protection Agency considers it possible to issue such a permit for the pro-posed Black Fox Station. The actual NPDES Permit is not required until 50 days prior to any discharge covered by it, therefore, it will not be needed until the operating license stage.

With respect to the proposed Black Fox Station, 'ooth the environmental and radiological health and safety hearings have been completed. Environmental prehearing conferences were held in Tulsa, Oklahoma on July 21, 1976, January 6, 1977, February 15, 1977 and June 27, 1977.

Environmental and site suitability hearings were held in Tulsa on August 22-September 9,1977, Oct:ber 17-21, 1977 and June 5-6, 1978. Based on the record of these hearings, the presiding Atomic Safety and Licensing Board issued a Partial Initial De-cision on July 24, 1978. The Partial Initial Decision authorized the Nuclear Regulatory Comission staff to issue a Limited Work Authorization which would allow Public Service Company of Oklahoma to perform certain limited construc-tion activities for the Black Fox Station. The Limited Work Authorization was issued on July 26, 1978.

A radiological health and safety prehearing conference was held in Tulsa on June 29-30, 1978 and radiological health and safety hearings were held in Tulsa on October 10-20,1978, December 5-13, 1978 and February 19-28, 1979. While the hearings were concluded on February 28, 1979 and no fur-ther hearings are scheduled at this time, motions by the State of Oklahoma and the intervenors to stay the proceedings and to reopen the record, respectively, are under advisement by the presiding Atomic Safety and Licensing Board pending the conclusion of our evaluatioa of the safety ramifications of the Three Mile Island accident on the proposed Black Fox Station.

1. Change in Discharge All discharges authorized herein shall be consistent with the terms and conditions of this permit. The discharge of any pollutant identified in this permit more frequently than or at a level in excess of that authorized shall constitute a violation of the permit. Any anticipated facility expansions, prcduction increases, or process modifications which will result in new, different. or increased discharges of pollutants must be reported by submission of a new NPDES application or,if such chsnges will not violate the effluent limitations specified in this permit. by notice to the permit issuing authority of such changes. Following such notice, the permit may be modified to specify and limit any pollutants not previously !!=ited.

A description of the discharge and cause of noncompliance;and s.

b. The period of noncompliance, including exact dates and times; or, if not c r'rected, the anticipated time the noncompliance is expected to continue, and steps being taken to reduce., eliminate and prevent recurrence of the concomplying discharge.
3. Facilities Operation The permittee shall at all times maintain in good working order and operate as efficiently as possible all treatment or control facilities or systems installed or used by the permittee to achieve compliance with the terms and conditions of this permit.

Adverse Impact The permittee shall take all reasonable steps to minimize any adverse impact to navigable waters resulting from noncempliance with any effluent limitations specified in this permit, including such accelerated or additional monitoring as necessary to determine the nature and impact of the noncomplying discharge.

5. Bypassirig Any diversion from or bypass of facilities necessary to maintain compliance with the terms and conditions of this permit is prohibited, except (i) where unavoidable to prevent loss of life or severe property damage, or (iii where excessive storm drainage or runoff would damage any facilities necessary for compliance with the effluent limitations and prohibitions of this permit. 'Ihe permittee shall promptly notify the Regional Administrator and the State in writing of each such diversion or bypass.

4. PermitModification

After notice and opportunity for a hearing, this permit may be modified, suspended, or revokea in wholc or in part during its term fer cause including, but not limited to, the following:

a.

W!ation of any terms or conditions of this permit;

b. Obtaining this permit by mlareprestatation or failure to disclose fully all relevant facts; or A change in any condition that requires either a temporary or permanent reduction or c.

elimination of the authorized discharge.

  • 5. Toxic Pollutants Notwithstanding Pr.rt II, B-4 above, if a toxic effluent standara or prohibition (including any schetule of compliance specified in such effluent standard or prohibition) is established under Section 307(a) of the Act for a toxic pollutant which is present in the

. discharge and such standard or ~ prohibition is more stringent than any limitation for such pollutant in this perniit, this permit shall be revised or modified in accordance with the toxic effluent standard or prohibition arti the permittee so notified.

6. Civiland CriminalLiability Except as provided in permit conditions on " Bypassing" (Part II, A 5) and " Power Failures" (Part II, A-7), nothing in this permit shall be construed to relieve the perm;ttee from civil or enminal penalties for noncompliance.
7. Oil and Hazardous Substance Liability Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the permittee from any responsibilities, liabilities, or penalties to which the permittee is or may be subject under Section 311 of the Act.

8.. State Laws Nothing in this permit shall be construed to prect.ude the inssitution of any legal action or relieve the permittee from any responsibilities, liabilities, or penalties established pursuant to any applicable State law or regulat!on under authority preserved by Section 510 of the Act.

Neither free available chlorine nor total residual chlorine may be discharged from any unit for more than two hours in any one day and not more than one unit in any plant may discharge free available or total residual chlorine at any one time unless the permittee can demonstrate to the permitting Agency that the units in a particular location cannot operate at or below the limitations specified in this pemit.

The term " construction runoff" means the rainfall runoff from any con-struction activity and any earth surface disturbed by such activity from the inception of construction until construction is complete and any disturbed earth is returned to a vegetative or other cover co m.en-surate with the intended land use.

metal process equipment including but not limited to; boiler tube clean-ing, boiler fireside cleaning and air preheater cleaning.

The term "10 year, 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> rainfall event" shall mean a rainfall event with a probable recurrance interval of once in ten years as defined by tne National Weather Service in Technical Paper No. 40, " Rainfall Fre-quency Atlas of the United States," May 1961, and subsequent amendments, or equivalent regional or state rainfall probability information devel-oped therefrom.
