NATURAL RESOURCES DEFENSE COUNCIL REPLY TO APPLICANT'S OPPOSITION TO NRDC'S MOTION TO COMPEL First, our copy of Applicant's Response to NRDC's Request for Admissions did not include a sworn affidavit of Ralph W.
Bostian, and we have never seen such an affidavit.
Second, Applicant has totally misread the use of the term "when needed" in Northern States Power Company (Prairie Island 1 and 2), ALAB-445, 7 NRC 41, 51 (1978), referring to permanent spent fuel repositories which was the subject of the original NRDC petition for rulemaking.
