Dear Mr. McCorkle:

Since the installation of our protected area fenceline, ero-sion, frost-heaves and excavation have combined to effectively reduce the height of the fence in some areas to slightly less than the eight-foot minimum specified in 10 CFR 73.2 (f) (1).

It is our understanding that an exemption to the fence height requirement can be granted, at no cost, for + 10% of the re-quired height (9.6") under the provisions of 10 CFR 73.5.

Accordingly, we request an exemption to the fence height re-quirement, such that the protected area fence will be main-tained at a minimum height of 7.2 feet.
