.m The Commission discussed a proposed Order concerning the conduct of a hearing on License No. XSNM-1222, and approved the following course of action:

1.

By a vote of 3-2, with Chairman Hendrie and Commissioner Gilinsky dissenting, the Commission agreed to hold a hearing on License No. XSNM-1222; 2.

by a vote of 4-0, with Commissioner Gilinsky abstainine> the Commission agreed that the hearin-m would be conducted on a written basis; 3.

by a vote of 3-0a with Commissicners Gilinskv and Ahearne abstaininc, the. Commission acreed that the written comments of the participants should be submitted to the Office of the Secretary within 30 days of the date the Order is published in the Federal Register; 4.

by a vote of 2-1, with Commissioner Ahearne dissenting and Commissioners Gilinsky and Eradford abstaining, the Commission agreed that participants may file responses to comments submi::ed by other partic; pants within 10 days after the date when the initial comments are due; 7soo.19of7

by that date, ordered oral presentations.

In the-avent oral presentations are ordered, such presente -ions will be held 14 days after the date of the Order requesting such presentations and the hearing will be considered completed at the conclusion of such presentations; 7.

by a vote of 4-0, with Commissioner Gilinsky abstaining, the Commission agreed that the Department of State should be listed as a participant in the hearing, along with the NRC staff and the petitioner, with the understanding that the Department may choose not to participate if they desire; 8.

by a vote of 4-0, with Commissioner Gilinsky abstaining, the Commission agreed that the four topics set forth in the proposed Order were adequate the intended primary focus of the hearing, as subject to rephrasing of Topic 1 to read "the sufficiency, for purposes of the Nuclear Non-Proliferation Act...," and the rephrasing of Topic 2 to read "the adequacy, for purposes of NRC's determination under the NNPA...";

The Commission, by a vote of 4-0, with Commissioner Gilinsky abstaining, requested that the proposed Order be. revised as indicated above.

(Subsequently, the Secretary signed the Order on December 8, 1978.

The Order established January ll, 19.79 as the date on which initial written comments'are due, January 22, 1979 as the date for submittal of reply comments, and January 29, 1979 as the cate for completion of the hearing in the event no oral presentations are requested.)
