This refers to your February 13, 1979 letter (NIS:79-2-23), which trans-mitted the Training and Qualification Plan for the Naval Products Divi-sion.

Section 70.32(e) of Part 70 clearly allows a licensee on his own initia-tive to make certain changes to a security plan without prior Commission approval' however, these changes do not include a licensee's compliance with new requirements promulgated by Commission regulations which require review and approval.

Your guard training and qualifications plan was not filed pursuant to 70.32(e), but rather, the plan was submitted in accor-dance with the requirements of 10 CFR 73.50(h) and Appendix B of Part 73.

Thus, licensees are required by regulation to file these plans for Commis-sion review and approval.

Footnote 1(d) of 8170.31 of the enclosed Part 170 provides in part that, amendments which result from NRC written requests may be exempt from fees when the amendment is issued for the convenience of the Commission.

Your compliance with the requirements of the Commission's regulations is not considered as complying with an NRC written request of the type referred to in Footnote 1(d).

In addition, the review and approval of the subject plan is not being done for the convenience of the Commission.

Therefore, we do not consider the filing of your guard training and qualifications plan for review and approval as exempt from fees.

The Licensing staff has informed us that the review of the plan will require a major review effort and a specific amendment to the license.

You are requested to remit a major amendment fee of $8,300 as specified in fee Category 1A of Section 170.31 of the enclosed Part 170.

Payment should be made to the U.S. Nuclear Regulatory Commission and mailed to the attention of Mr. Douglas Weiss, License Fee Management Branch.

United Nuclear Corporation Upon receipt of the fee, we will forward.your guard training and quali-fications plan to the Licensing staff for processing. When review of the~ plan is complete, we will notifiy you of the actual costs incurred in the review and, if necessary, refund any overcharge.
