Dear Ms. Ragan:
This is in response to your letter dated February 19, 1979 in which you requested, pursuant to the Freedom of Information Act, a copy of the RrP and the winning technical proposal for the contract NRC-02-79-035,
" Safeguards for High-Level Waste Repositories."
A copy of the RFP and Section 2 of the four documents listed in Appendix A are enclosed.
The remainder of these documents are considered confidential business (proprietary) information by Science Applications, Inc. (SAI) and are being withheld from public disclosure pursuant to exemption (4) of the Freedom of Information Act (5 U.S.C. 552(b)(4)) and 10 CFR 9.5(a)(4) of the Commission's regulations.
We have asked SAI to rejustify their proprietary claim, and will let you know whether any additional portions of these documents may be released to the public.
In a March 16, 1979 telephone conversation with Ms. Mary Jean Raphael of my staff you were informed that the NRC does not expect to receive SAI's proprietary justification until approximately April 16, 1979. We will respond to you promptly after receipt of that letter.
Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or discloeure, and that its production or disclosure is contrary to the public interest.
The persons responsible for this denial are the unders agned and Mr. Edward L. Halman, Director, Division of Contracts.
This denial may be appealed to the Commission's Executive Director for Operations within 30 days from the receipt of this letter.
As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, D.C. 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."
In a March 8,1979 telephone conversation with Ms. Ellen Whitlow of my staff, Mr. Friedman agreed to bear the costs of reproducing the technical proposal. The charge for reproducing records not located in the NRC Public Document Room (pDR) is $0.10 per page, as specified in 10 CFR 9.14(b), of the Commission's regulations. Accordingly, the cost of reproducing the enclosed 112 page technical proposal is $11.20.
