This is in regard to the telephone conversation between Carl Paperiello of this office and you on January 26, 1979, regarding your NRC License No. 34-16555-01.

Condition No. 12 of your license requires that licensed byproduct material be used by or under the supervision of E. V. Briggs.

As you informed us on the telephone, Mr. Briges is no longer with your company, and other unauthorized individuals are using the licensed device.

This is contrary to the requirement of License Condition 12 and a violation of NRC regulations.

Steps should be taken to insure that s NRC licensed materials are hereafter possessed and used only as

. authorized by your license.

4 You indicated that you would like to amend your license to include a new user or users. NRC Form 313 is enclosed for this purpose. Also included in 10 CFR 170, " Fees for Facilities and Materials Licenses...."

The amendment fee for your license is

$40.00, as indicated on this schedule.

The survey questionnaire discussed in the same conversation is also enclosed. We request that it be completed and returned in the enclosed envelope as soon as possible.

4 Centlemen:

The Nuclear Regulatory Commission is considering methods for increasing the frequency of its contact with certain byproduct _caterials licensees.

In lieu of increasing the frequency of onsite inspections, the NRC is considering a program that would require certain licensees to respond to a survey questionnaire that would be mailed to them on an established frequency, such as at two or three year intervals. The licensees con-sidered for inclusion in this program are those where the licensed activity has a low inherent hazards potential, consequently they are placed in a group of " low inspection priority" licenses.

In order to determine if a questionnaire survey would be beneficial to both the NRC and the licensees, we are conducting a voluntary one-time test of the questionnaire program. Your license is in the category of low inspection priority licenses and has been selected for inclusion in this voluntary program. We request your cooperation in the program and ask you to complete and return the enclosed survey questionnaire within 30 days.

No enforcement action will be taken as a result of answers to this questionnaire. Rather, its purpose is to serve as a reminder of your responsibilities for adhering to the requirementr of NRC regulati:ns and
