ORDER REGARDING FUTIWS FCR EXTENSION OF TDE (February 28, 1979)

I.

Central Power and Light Ccepany (CPL) has requested an extension of time within which to respond to the First Set of Interrogatories filed by Housten Lighting and Power Cmpany (HLSP). The time extension requested is to March 23, 1979. However, the Board believes that such responses should be filed ba%re the Prehearing Conference scheduled for March 20, 1979. Accordingly, CFL may have to and including March 16, 1979 in which to respond to these interrogatories.

II.

On February 22, 1979, the Department of Justice (Department) filed a notion for an extension of time within which to respond to HLSP's Second Set of Interrogatories. Ihe Department centends that the infor-mation sought is praature as it concerns the identity of witnesses expected to be called and simmries of testinony and documents.

A response and objectice ;o this notion %as filed by FLAP on February 27, 1979.

It is contended that the Department's 18 page advice letter dated February 21, 1978 triggered this proceeding, and that Fl&P is entitled to a prcrI:pt disclosure of the basis for such an analysis, including depositions of those making the factual, economic or engineering analyses.

The Board will defer ruling on this notion until after the Prehearing Ccnference to be held on March 20, 1979 and it is expected that counsel will be heard on this issue during the course of the conference.
