Dear Mr. Chairman:

Section 12 of Public Law 95-601 directs the Nuclear Regulatory Comission, in cooperation with the Department of Energy to conduct a study of extending the Commission's licensing and regulatory authority to include categories of existing and future radioactive waste storage and disposal activities not presently subject to such authority. As our respective staffs have discussed, the Commission will, regrettably, not be able to meet

the statutory reporting date of March 1,1979 to the Congress for the reason stated below.

riowever, we believe that we can reasonably meet our obligation by April 1.

The NRC Staff has completed the report but has requested additional time in order to obtain comments from DOE on the report and its recomendations.

The Comission feels that it is quite important to get DOE's views on the report and the staff's proposed recomendations before the Commission makes its final recomendations.

DOE was asked to' comment on an earlier draft of the report and staff comments were provided to us.

This later draft has been substantially revised and contains conclusi_ons and ~

recomendations that were not in the earlier version.

We have requested a5ency coments from DOE on the latest draft.

The additional time would hopefully provide us their official

. agency. views on such matters as the national security implications of extending NRC authority over DOE waste activities, cost estimates for dealing with the various regulatory options being considered, and descriptions of their environmental, health and safety programs.
